This Privacy Policy explains what personal data BHARATCAREAI collects from you, why we collect it, how we use it, how we protect it, who we share it with, and what rights you have over your data. By using BHARATCAREAI you confirm that you have read, understood, and agreed to this Privacy Policy.
1. Who We Are
BHARATCAREAI is an AI-powered primary health triage platform developed and operated by AFTR Labs, Pune, Maharashtra, India.
BHARATCAREAI is a health triage and decision support tool. It is not a diagnostic device, not a medical treatment platform, and not a substitute for professional medical consultation. All health guidance provided by BHARATCAREAI is for informational purposes only.

2. What This Policy Covers
This Privacy Policy applies to all personal data collected through the BHARATCAREAI mobile application, website, and any related services provided by AFTR Labs.
This Policy does not apply to third-party websites, applications, or services that may be linked from BHARATCAREAI. Please review the privacy policies of those third parties independently.
If you do not agree to this Privacy Policy please do not use BHARATCAREAI.
3. What Data We Collect
We collect only the minimum data necessary to provide you with a health triage assessment. We do not collect data we do not need.
3.1 Data You Provide Directly
• Age — used to contextualise your health assessment. Older and younger users face different health risks for the same symptom patterns.
• Gender — used to display the appropriate body map variant (male or female silhouette) and to contextualise your assessment clinically.
• Known medical conditions — optional. Used only to improve the relevance of your assessment output.
• Symptom descriptions — the pain points you select, the body areas you tap on the body map, the description you type or speak, and your answers to follow-up questions. This is the core data that powers your assessment.
• Sensitive health data — if you select sensitive anatomical zones including genital areas, rectal areas, or breast areas, these are treated as a special category of sensitive personal data under DPDP Act 2023 and receive the highest level of protection we offer.
• Voice input — if you choose to describe symptoms by voice, your audio is processed in real time to generate text. We do not store raw audio recordings. Only the transcribed text is retained.
3.2 Data We Collect Automatically
• Approximate location — district level only. We never collect your exact GPS coordinates. District-level location is used to contextualise your assessment for regional disease patterns (for example monsoon-related conditions in specific districts) and to show you the nearest healthcare facility in emergency situations.
• Device information — device type, operating system version, and app version. Used only for technical support and app performance improvement.
• Session data — time of assessment and assessment completion status. Used for anonymised aggregate analytics only.
• Crash and error logs — anonymous technical logs used to identify and fix technical problems. These do not contain health data.
3.3 Data We Do NOT Collect
• Your full name — unless you voluntarily provide it during registration.
• Your phone number — unless you choose to register with it.
• Your exact GPS coordinates.
• Financial information of any kind.
• Data from your contacts, camera, or other device features beyond what is necessary for the assessment.
• Your microphone data continuously — voice input uses your microphone only during active voice description. It is not monitored at any other time.
• Social media data or browsing history.
4. Why We Collect This Data — Purpose Limitation
Under the DPDP Act 2023 we are required to collect data only for specific, clear, and lawful purposes. Here are our purposes and the data used for each:
• Primary purpose — to generate your health triage assessment. All symptom data, profile data, and body map selections are used solely to produce your assessment output.
• Safety purpose — to trigger emergency escalation when your symptom pattern indicates a potentially life-threatening situation. In these cases your district-level location is used to display the nearest healthcare facility.
• Improvement purpose — anonymised, aggregated, non-identifiable assessment data is used to improve the accuracy and relevance of our AI model over time. No individual user's data is used for this purpose in an identifiable form.
• Research purpose — anonymised aggregate data may be used for public health research including disease surveillance and epidemiological analysis. This data cannot be traced back to any individual user. You will be informed if this scope changes and fresh consent will be obtained.
⚠ What we will never do
We will never use your health data for advertising. We will never sell your health data to any third party for commercial purposes. We will never use your data to build advertising profiles. We will never share your identifiable health data with insurers, employers, or government bodies without your explicit consent except where required by Indian law.
5. Legal Basis for Processing
We process your health data on the basis of your explicit informed consent obtained before your first assessment. You may withdraw this consent at any time by deleting your account and requesting data deletion as described in Section 9.
For sensitive personal data — including symptom data, body map selections, and sensitive anatomical zone selections — we obtain specific explicit consent separately from general app consent before you begin your first assessment.
In emergency situations where your safety or the safety of others is at risk we may process data without consent to the extent permitted under Indian law.
6. How We Store and Protect Your Data
6.1 Storage Location
All personal health data of Indian users is stored on servers located in India in compliance with data localisation requirements under Indian law. We do not transfer your health data outside India without your explicit consent and appropriate legal safeguards.
6.2 Encryption
All data is encrypted in transit using TLS 1.2 or higher. All data is encrypted at rest using AES-256 encryption. Your health assessment data is additionally encrypted at the application layer before database storage.
6.3 Access Controls
Access to identifiable user health data within AFTR Labs is restricted to authorised personnel only on a need-to-know basis. All access to health data is logged and audited. Employees with access to health data are bound by confidentiality obligations.
6.4 Data Retention
Your assessment data is retained for [X months — confirm with lawyer]. After this period it is either permanently deleted or fully and irreversibly anonymised. You may request earlier deletion at any time as described in Section 9.
Anonymised aggregate data that cannot be traced to any individual user may be retained indefinitely for research and product improvement purposes.
6.5 Breach Notification
In the event of a data breach affecting your personal data we will notify you and the relevant authority within the timeframe required under the DPDP Act 2023. Notification will include the nature of the breach, the data affected, and the steps we are taking to address it.
7. Who We Share Your Data With
We do not sell your personal health data. Ever. The following describes the limited circumstances under which we share data with third parties.
7.1 AI Processing — Google Gemini API
Your symptom data is processed by Google's Gemini API to generate your health assessment. Google processes this data as a data processor on our behalf under a data processing agreement. Google does not use your health data to train its general AI models. For Google's data processing terms see [link]. All data sent to Google's API is transmitted over encrypted connections.
7.2 Emergency Situations
If your assessment triggers a Seek Immediate Care result your district-level location may be used to identify and display the nearest healthcare facility. No data is automatically transmitted to emergency services — this is display information only. Calling 108 is the user's action, not an automated transmission.
7.3 Legal Requirements
We may disclose data if required by Indian law, a court order, or a competent government authority. We will notify you of such requests where legally permitted to do so. We will only disclose the minimum data necessary to comply with any such requirement.
7.4 Business Transfer
In the event of a merger, acquisition, or sale of AFTR Labs, user data may be transferred to the acquiring entity subject to the same privacy protections described in this Policy. You will be notified in advance and may request deletion before any such transfer.
7.5 With Your Explicit Consent
We may share your data with hospitals, insurance companies, pharmaceutical companies, researchers, or any other third party only with your explicit, specific, and informed consent obtained at the time of sharing. Consent for assessment purposes does not constitute consent for these additional sharing purposes.
8. Children's Privacy
BHARATCAREAI is not intended for independent use by children under 18. Users between 13 and 18 years of age may use BHARATCAREAI only with the explicit consent and active supervision of a parent or legal guardian.
BHARATCAREAI is not intended for children under 13 under any circumstances.
If you are using BHARATCAREAI on behalf of a minor you confirm that you are the parent or legal guardian and that you consent to the collection and use of the minor's health data as described in this Policy.
We do not knowingly collect personal data from children under 13 without verified parental consent. If you believe we have inadvertently collected such data please contact our Grievance Officer immediately at support@alteringfuture.com.
9. Your Rights Under DPDP Act 2023
As a user of BHARATCAREAI you have the following rights over your personal data:
• Right to access — you may request a complete copy of all personal data we hold about you. We will provide this within [X days — confirm with lawyer].
• Right to correction — you may request correction of any inaccurate or incomplete personal data we hold about you.
• Right to deletion — you may request permanent deletion of all your personal data at any time. We will process deletion requests within [X days]. Anonymised aggregate data that cannot be traced to you is not subject to deletion requests.
• Right to withdraw consent — you may withdraw your consent to data processing at any time. Withdrawal does not affect the lawfulness of processing that occurred before withdrawal. After withdrawal you will no longer be able to use BHARATCAREAI.
• Right to data portability — you may request your personal data in a commonly used, machine-readable format.
• Right to grievance redressal — you may file a complaint with our Grievance Officer at support@alteringfuture.com. We will respond within 72 hours. If you are not satisfied with our response you may escalate to the Data Protection Board of India once established under the DPDP Act 2023.
To exercise any of these rights contact us at [privacy@bharatcare.in]. We may require you to verify your identity before processing any request.
10. Cookies and Tracking
The BHARATCAREAI mobile app does not use advertising cookies or third-party tracking technologies. We use only essential session tokens necessary for the app to function correctly.
We do not track you across other apps or websites. We do not share any tracking data with advertising networks or data brokers.
If BHARATCAREAI operates a website, the website privacy notice will describe any cookies used on the website separately.
11. Third Party Links
The BHARATCAREAI app may display links to third party resources including nearby hospital websites, health information resources, or emergency service websites. We are not responsible for the privacy practices, content, or accuracy of these third parties. Please review their privacy policies independently before sharing any personal data with them.
12. Changes to This Policy
We may update this Privacy Policy from time to time as our product evolves or as regulatory requirements change. We will notify you of material changes through the app at least 30 days before they take effect.
Continued use of BHARATCAREAI after the effective date of an updated Policy constitutes your acceptance of the updated Policy. If you do not agree to the updated Policy you must stop using BHARATCAREAI and may request deletion of your data.

BHARATCAREAI provides health triage and guidance only. It is not a diagnostic tool. It does not diagnose medical conditions. It does not prescribe medication or treatment. Any references to over-the-counter medications in BHARATCAREAI’s output are informational suggestions only and do not constitute medical recommendations. It does not replace the advice, diagnosis, or treatment of a qualified medical professional. Always consult a qualified and registered doctor for any medical condition. In an emergency call 108 immediately. The health guidance provided by BHARATCAREAI is based on the symptom information you provide. The accuracy of your assessment depends on the completeness and accuracy of your inputs. BHARATCAREAI is not liable for assessments based on incomplete or inaccurate information provided by the user.
14. Governing Law
This Privacy Policy is governed by the laws of India including the Digital Personal Data Protection Act 2023, the Information Technology Act 2000, and all applicable rules and regulations thereunder.
Any disputes arising from this Privacy Policy that cannot be resolved through our grievance redressal process shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.

TERMS OF SERVICE

These Terms of Service govern your use of BHARATCAREAI. By downloading, installing, or using BHARATCAREAI you confirm that you have read, understood, and agreed to these Terms in full. These Terms should be read alongside our Privacy Policy which forms part of this agreement.
1. About These Terms
These Terms of Service ("Terms") govern your use of the BHARATCAREAI mobile application ("App") and all related services provided by AFTR Labs ("we", "us", "our"), a company registered in Pune, Maharashtra, India.
If you do not agree to these Terms in full do not download, install, or use BHARATCAREAI.
These Terms form a legally binding agreement between you and AFTR Labs. If you are using BHARATCAREAI on behalf of an organisation you confirm that you have the authority to bind that organisation to these Terms.
2. What BHARATCAREAI Is — And What It Is Not
2.1 What BHARATCAREAI Is
BHARATCAREAI is an AI-powered primary health triage and decision support tool. It is designed to help you understand your symptoms, identify probable health conditions based on the information you provide, receive practical home management guidance, and determine when professional medical attention may be required.
2.2 What BHARATCAREAI Is Not
• BHARATCAREAI is NOT a medical device.
• BHARATCAREAI is NOT a diagnostic tool and does NOT diagnose medical conditions.
• BHARATCAREAI does NOT prescribe medication or treatment.
• BHARATCAREAI is NOT a substitute for professional medical advice, diagnosis, or treatment.
• BHARATCAREAI is NOT an emergency medical service.
• BHARATCAREAI is NOT a telemedicine platform.
• BHARATCAREAI is NOT a replacement for a doctor's consultation.
2.3 The Nature of Our Output
All assessments generated by BHARATCAREAI are probabilistic guidance based on the symptom information you provide. They represent possible conditions — not confirmed diagnoses. The accuracy of any assessment depends entirely on the completeness and accuracy of the information you provide.

Always consult a qualified and registered medical professional for any health concern. Never delay seeking professional medical advice, never ignore professional medical advice, and never make medical decisions based solely on BHARATCAREAI's output. This is not a disclaimer buried in fine print. It is the fundamental nature of what this product is.
3. Who Can Use BHARATCAREAI
3.1 Age Requirement
You must be 18 years of age or older to use BHARATCAREAI independently. Users between 13 and 18 years of age may use BHARATCAREAI only with the explicit consent and active supervision of a parent or legal guardian. BHARATCAREAI is not intended for children under 13 under any circumstances.
3.2 Legal Capacity
By using BHARATCAREAI you confirm that you have the legal capacity to enter into a binding agreement under Indian law.
3.3 Geographic Scope
BHARATCAREAI is designed and optimised for use in India. The clinical context, medication references, healthcare facility recommendations, emergency contact information, and regional disease pattern data are India-specific. Use of BHARATCAREAI outside India is at your own risk and we make no representations about the accuracy or relevance of assessments for health contexts outside India.
3.4 Accurate Profile Information
You must provide accurate profile information including your age, gender, and any relevant known medical conditions. Inaccurate profile information directly degrades the quality and accuracy of your assessment. We are not liable for inaccurate assessments resulting from inaccurate profile information you provided.
4. Your Account
4.1 Registration
BHARATCAREAI may be used without registration for basic assessments. If you choose to create an account to access premium features including family profiles and health history tracking you must provide accurate and current information and keep it updated.
4.2 Account Security
You are solely responsible for maintaining the security and confidentiality of your account credentials. You must notify us immediately at support@alteringfuture.com if you suspect any unauthorised access to your account or any security breach. We are not liable for any loss or damage arising from your failure to maintain account security.
4.3 Account Use
Each account is for your individual personal use only. You may not share your account credentials with any other person. Family members should be added through the family profile feature available in Premium — not through account sharing.
4.4 Account Termination
We reserve the right to suspend or permanently terminate your account without notice if you violate these Terms, provide false or misleading information, misuse the App, attempt to circumvent our systems, or engage in any conduct that could harm other users, the integrity of our service, or the reputation of BHARATCAREAI. We will notify you of termination where reasonably possible.
5. Using BHARATCAREAI Responsibly
5.1 Provide Accurate Symptom Information
You must provide accurate and complete information about your symptoms when using BHARATCAREAI. Inaccurate or incomplete symptom information will result in inaccurate or misleading assessments. We are not liable for assessments based on information you provided that was inaccurate, incomplete, or deliberately misleading.
5.2 Emergency Situations — CRITICAL
⚠ EMERGENCY — READ THIS
BHARATCAREAI is NOT an emergency service. If you or someone else is experiencing a medical emergency — including but not limited to chest pain, difficulty breathing, loss of consciousness, severe bleeding, stroke symptoms, severe allergic reaction, or any other life-threatening situation — call 108 IMMEDIATELY. Do not use BHARATCAREAI as your first response to a medical emergency. When BHARATCAREAI generates a Seek Immediate Care result this is an automated indicator based on your symptom inputs only. It does not replace emergency medical assessment. Call 108 immediately in any life-threatening situation regardless of what the App indicates.
5.3 Not a Replacement for Medical Care
You must not use BHARATCAREAI as a replacement for professional medical consultation. If your symptoms persist, worsen, or concern you — regardless of what BHARATCAREAI indicates — consult a qualified and registered doctor promptly. BHARATCAREAI's assessment does not substitute for physical examination, laboratory tests, or clinical evaluation by a medical professional.
5.4 Medication Guidance
Where BHARATCAREAI references commonly available over-the-counter medications, these references are informational suggestions only. They are not medical recommendations, not clinical advice, and not prescriptions. BHARATCAREAI does not recommend any specific medication for any condition. Any mention of an over-the-counter product is purely suggestive and for general awareness only — it must not be interpreted as a professional medical recommendation or endorsement of that product. Always consult a qualified pharmacist or registered doctor before taking any medication, including over-the-counter products. Never exceed recommended dosages. Never take prescription medication without a doctor’s valid prescription. Never stop taking prescribed medication based on BHARATCAREAI’s output.
5.5 Mental Health
If you are experiencing a mental health crisis, suicidal thoughts, thoughts of self-harm, or severe psychological distress do not rely on BHARATCAREAI. Contact the following immediately:

5.6 Prohibited Uses
You must not use BHARATCAREAI for any of the following purposes:
• Any purpose that violates Indian law or any applicable law or regulation.
• Providing health assessments to third parties as if you were a qualified medical professional.
• Fraudulently obtaining insurance claims, government benefits, or sick leave based on BHARATCAREAI output.
• Reverse engineering, decompiling, or attempting to extract our underlying AI model, algorithms, or proprietary technology.
• Scraping, harvesting, or collecting data from the App through automated means.
• Introducing malware, viruses, ransomware, or any harmful code into the App or our systems.
• Impersonating any person or entity or misrepresenting your affiliation with any person or entity.
• Using the App in any way that could damage, disable, overburden, or impair our servers or systems.
• Attempting to gain unauthorised access to any part of our systems or another user's account.
• Using BHARATCAREAI for any commercial purpose without our explicit written consent.
6. Health Data and Privacy
Your health data is governed by our Privacy Policy which forms an integral part of these Terms. By using BHARATCAREAI you consent to the collection and use of your health data as described in the Privacy Policy.

• We collect only the minimum health data necessary to provide your assessment.
• All data is stored on servers in India.
• We do not sell your health data to any third party.
• Your symptom data is processed by Google's Gemini API under a data processing agreement.
• You have the right to access, correct, and permanently delete your data at any time.
• Sensitive anatomical zone data receives the highest level of protection we offer.

7. Intellectual Property
7.1 Our Intellectual Property
All content, features, technology, algorithms, AI models, designs, trademarks, trade names, service marks, logos, and all other intellectual property in BHARATCAREAI are owned by AFTR Labs or our licensors. Nothing in these Terms gives you any ownership rights or licence to our intellectual property beyond the limited use licence described below.
7.2 Your Limited Use Licence
We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use BHARATCAREAI on your personal Android device solely for your personal health triage purposes in strict accordance with these Terms.
7.3 Your Content
Any symptom descriptions, voice inputs, or text you submit through BHARATCAREAI remain your property. You grant us a worldwide, royalty-free, non-exclusive licence to process, store, and use this content solely for the purpose of generating your health assessment and improving our service as described in the Privacy Policy.
7.4 Feedback
If you provide us with feedback, suggestions, or ideas about BHARATCAREAI we may use this feedback without any obligation to you and without compensation. You waive any rights you may have in such feedback to the extent permitted by Indian law.
8. Subscription and Payment
8.1 Free Tier
The basic health assessment feature of BHARATCAREAI — including individual symptom assessment, home management guidance, red-flag warnings, and urgency determination — is available free of charge. 3 assessments allowed per month in free tier, account registration is required for basic assessments and free assessments.
8.2 Premium Tier
BHARATCAREAI Premium is available at ₹25 per use for symptom check ₹349 per month for 3+15 symptomcheck and 10 vision checks or ₹2499 per year 200+3 and 150+2 Vision Checks . Premium features include health history tracking across multiple sessions, family profiles for up to 25 family members, and priority features as described in the App at the time of subscription.
8.3 Payment Processing
All payments are processed through [payment processor name — e.g. Razorpay /UPI . We do not store your payment card details. All payment transactions are governed by the payment processor's terms and conditions in addition to these Terms.
8.4 Automatic Renewal
Premium subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You authorise us to charge your payment method on a recurring basis until you cancel.
8.5 Cancellation
You may cancel your Premium subscription at any time through the App settings or by contacting support@alteringfuture.com. Cancellation takes effect at the end of the current billing period. You retain Premium access until that date. Cancellation does not entitle you to a refund for the current billing period except as described in Section 8.6.
8.6 Refunds
Subscription fees are generally non-refundable except where required by the Consumer Protection Act 2019 or other applicable Indian consumer protection law. If you believe you are entitled to a refund please contact us at support@alteringfuture.com with your account details and reason for the refund request within 7 days of the charge.
8.7 Price Changes
We may change Premium subscription pricing with 30 days advance notice delivered through the App. Continued use of Premium after the notice period constitutes acceptance of the new pricing. If you do not accept the new pricing you may cancel your subscription before the new pricing takes effect.
8.8 Free Trials
We may offer free trial periods for Premium features from time to time. At the end of a free trial period your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. Free trial eligibility and duration will be clearly communicated at the time of sign-up.
9. Limitation of Liability
9.1 No Medical Liability
AFTR Labs is a technology company, not a medical provider or healthcare institution. We are not liable for any health outcome, positive or negative resulting from your use of or reliance on BHARATCAREAI's assessments, guidance, or any content provided through the App.
9.2 Assessment Accuracy
We do not warrant that any assessment generated by BHARATCAREAI is accurate, complete, current, or applicable to your specific health situation. Assessments are probabilistic and are based solely on the symptom information you provide. We are not liable for any inaccurate assessments resulting from inaccurate, incomplete, or misleading information you provided.
9.3 Service Availability
We do not warrant uninterrupted, error-free, or continuously available service. BHARATCAREAI may be temporarily unavailable due to scheduled maintenance, unscheduled technical issues, third party service failures, or circumstances beyond our reasonable control. We are not liable for any harm resulting from service unavailability.
9.4 Third Party Services
We are not liable for the actions, omissions, or failures of any third party service used in connection with BHARATCAREAI including Google's Gemini API,or any other API services we decide to use in future or payment processors, or cloud infrastructure providers.
9.5 Cap on Liability
To the maximum extent permitted by Indian law our total aggregate liability to you for all claims arising from your use of BHARATCAREAI whether in contract, tort, statute, or otherwise shall not exceed the total amount you paid us in the three months immediately preceding the event giving rise to the claim. If you are a free tier user our total liability shall not exceed ₹1,000.
9.6 Exclusion of Consequential Damages
To the maximum extent permitted by Indian law we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of or inability to use BHARATCAREAI including but not limited to loss of health, loss of income, medical treatment costs, loss of data, or loss of goodwill even if we have been advised of the possibility of such damages.
9.7 Consumer Rights Preserved
Nothing in this Section 9 limits or excludes any rights you have as a consumer under the Consumer Protection Act 2019 or any other applicable Indian consumer protection law that cannot be excluded or limited by agreement.
9.8 Force Majeure
We are not liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control including natural disasters, acts of government, war, civil unrest, pandemic, power failures, internet or telecommunications failures, or third party service failures.
10. Indemnification
You agree to defend, indemnify, and hold harmless AFTR Labs, its directors, officers, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or relating to:
• Your use of BHARATCAREAI in violation of these Terms or any applicable law.
• Your provision of inaccurate, misleading, or incomplete health or profile information.
• Your reliance on BHARATCAREAI's output as a substitute for professional medical consultation.
• Any content you submit through BHARATCAREAI that infringes any third party right.
• Any claim by a third party arising from your use of the App.
11. Third Party Services
BHARATCAREAI integrates with and depends on third party services to operate. By using BHARATCAREAI you acknowledge that your use is also subject to the terms of these third party services:
• Google Gemini API — for AI assessment generation. Subject to Google's Terms of Service and API usage policies.
• Payment Processor — e.g. Razor pay/UPI — for Premium subscription payment processing. Subject to their payment terms.
• Cloud Infrastructure Provider — for data storage and hosting.
• Crash Analytics Provider if any — for technical error reporting.
We are not responsible for any changes to, discontinuation of, or failures of third party services that affect BHARATCAREAI's functionality. We will endeavour to notify you of material changes to our third party service integrations where reasonably possible.
12. Changes to the Service
We may modify, update, suspend, restrict, or permanently discontinue any aspect of BHARATCAREAI at any time including features, functionality, content, pricing, and availability. We will provide reasonable advance notice of material changes where possible through the App.
We are not liable for any harm arising from changes to or discontinuation of any aspect of BHARATCAREAI provided we have given reasonable notice where the circumstances allow.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes in our product, business practices, or applicable law. We will notify you of material changes through the App at least 30 days before they take effect.
If you do not agree to the updated Terms you must stop using BHARATCAREAI before the effective date of the updated Terms and may request deletion of your account and data. Continued use of BHARATCAREAI after the effective date of updated Terms constitutes your acceptance of those Terms.
14. Dispute Resolution
14.1 Grievance Redressal — First Step
If you have any complaint, concern, or dispute about BHARATCAREAI or these Terms please contact our Grievance Officer at support@alteringfuture.com as a first step. We will acknowledge your complaint within 72 hours and endeavour to resolve it within 30 days.
14.2 Consumer Disputes
Nothing in these Terms limits your rights as a consumer under the Consumer Protection Act 2019. If your complaint is not resolved to your satisfaction through our grievance redressal process you may file a complaint with the relevant Consumer Disputes Redressal Commission.
14.3 Governing Law
These Terms are governed by and construed in accordance with the laws of India including the Consumer Protection Act 2019, the Information Technology Act 2000, the Digital Personal Data Protection Act 2023, and all applicable rules and regulations thereunder.
14.4 Jurisdiction
Any dispute arising from or relating to these Terms or your use of BHARATCAREAI that cannot be resolved through our grievance redressal process shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India. You consent to the personal jurisdiction of such courts and waive any objection to proceedings in such courts on grounds of venue or inconvenient forum.
14.5 No Class Actions
You agree that any dispute will be resolved on an individual basis and not as part of any class action, collective action, or representative proceeding. To the extent permitted by Indian law you waive your right to participate in any class action relating to BHARATCAREAI.
15. General Provisions
15.1 Entire Agreement
These Terms together with our Privacy Policy constitute the entire agreement between you and AFTR Labs regarding your use of BHARATCAREAI and supersede all prior agreements, understandings, representations, and discussions between you and us relating to the subject matter hereof.
15.2 Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
15.3 No Waiver
Our failure to enforce any provision of these Terms on any occasion does not constitute a waiver of our right to enforce that provision on any other occasion or our right to enforce any other provision of these Terms.
15.4 Assignment
You may not assign, transfer, or sublicence your rights or obligations under these Terms to any third party without our prior written consent. We may assign our rights and obligations under these Terms to any successor entity in the event of a merger, acquisition, corporate restructuring, or sale of all or substantially all of our assets. We will notify you of any such assignment.
15.5 Relationship of Parties
These Terms do not create any partnership, joint venture, employment, agency, or franchise relationship between you and AFTR Labs. You have no authority to bind AFTR Labs in any way.
15.6 Language
These Terms are written in English. In the event of any conflict between the English version of these Terms and any translated version the English version shall prevail to the maximum extent permitted by applicable law.
15.7 Notices
Any notices from us to you will be delivered through the App, by email to the address associated with your account, or by posting on our website. Any notices from you to us must be sent to support@alteringfuture.com or our registered address.
